Privacy Policy

This policy explains what information we collect, how we use and share it, how long we keep it, and how to ask us to remove it.

1. Who we are

This site is run by Lucas for Senate - Louise, Senator Louise Lucas's campaign committee, called the Campaign on this policy. See the FAQs for more about who runs the site and who pays for it.

2. What we collect

With one exception noted at the end of this list, we collect only what you enter or upload yourself.

  • Contact information. Your name, email address, and the city or county where you live. A phone number only if you choose to provide one.

  • Your account of what happened. What you tell us, along with the locality and, where you know it, the facility or utility involved.

  • Photographs and video you upload. Image files commonly contain embedded data about where and when they were taken. The FAQs describe how we handle it.

  • Your consent record. Which boxes you checked, and when. We retain this so that both of us can establish later what was agreed.

  • Server logs. IP address, browser type, and similar technical data, recorded automatically. This is the exception noted above. It is used to keep the site running and to measure traffic.

If we learn that we have received a submission from anyone under 18, we delete it.

3. What we use it for

  • Reviewing your story and deciding how to follow up.

  • Contacting you if we need to clarify something.

  • Publishing your story as you authorized it in the Submission Terms and Release.

  • Sharing your story with journalists, legislators, and the Virginia General Assembly, as described in that release.

  • Aggregate reporting, such as how many residents of a locality described the same impact.

  • Sending you email updates, if you asked for them.

  • Keeping the site secure and dealing with spam and abuse.

4. Where your information lives

The site is hosted on Wix and the submission form is a Wix form, so your story is received and stored in the Campaign's Wix account. Photographs and video are transferred to Google Drive, in a folder controlled by the Campaign. Wix and Google act as service providers. They hold this data because operating a website requires it, and they have no right to use your story for their own purposes.

Access is limited to the small team that reviews submissions. The Campaign controls who has access and removes it when someone leaves the project.

5. How we share information

We share only in these circumstances:

  • As you authorized. Your story, with the identification you chose, per the Submission Terms and Release.

  • With journalists, in two different ways. Your published story, as it appears on the site, we share freely. Your name and email we share only if you checked the box authorizing reporter contact.

  • With service providers who help us run the site, listed in Section 4. They receive only what they need to deliver their service and are bound by their own terms.

  • With legislators and government bodies, as described in the release.

  • To comply with law. See Section 6.

Your information is not for sale. It is not provided to any data center operator, utility, contractor, or industry trade association under any circumstance. It is not provided to allied organizations either, including coalition partners and nonprofits, unless we ask you first and you agree.

6. Legal requests

This is a contested policy dispute involving well resourced parties. It is possible that someone will seek this information through a subpoena, a court order, or a discovery request, and you should know that before you submit.

If that occurs, we will make a reasonable effort to direct the requesting party to seek the information from you instead. Where the law permits us to notify you, we will do so, so that you have an opportunity to object before we respond.

Nothing in this policy waives any objection you could raise yourself. Your own legal defenses remain yours.

7. Email updates

If you requested updates, they come from the Campaign and are political email. Some will concern data center policy, and some may ask you to support Senator Lucas. Every message includes an unsubscribe link, which we honor.

Your address is not provided to another campaign, a party committee, or a political action committee.

Unsubscribing and taking your story down are two different things. See Section 9.

8. How long we keep things

Submissions and contact details are retained for 24 months. At the end of that period we review what we hold and delete what is no longer in use, keeping only material still active in the policy effort.

Aggregate figures are retained indefinitely. Once we have reported that 40 households in a county described the same problem, that figure identifies no one, and there is nothing to delete.

Your consent record is retained for as long as we hold the material it covers. If your story is removed, the record is removed with it.

9. Your rights and choices

Under the Virginia Consumer Data Protection Act and similar laws elsewhere, you may have the right to get a copy of the personal information we hold about you, correct it, delete it, and withdraw consent to future contact.

You can make two distinct requests, and you can make both:

  • Take my story down. We remove it from the Site and from accounts we operate. If we had been providing it to reporters, that stops.

  • Delete my information. Your contact details are removed from our records and from any email list.

Email stories@mydatacenterstory.org with either request. We respond within 30 days. If we cannot do what you asked, we will tell you why, and you may appeal by replying to that response.

Two limits apply. We cannot recall material already published by a news outlet or reshared by third parties, and we cannot remove anything already entered into a legislative or regulatory record, which becomes a permanent public record.

10. Security

We take reasonable precautions, including encrypted connections, storage accessible only to a small number of named people, and routine deletion of material we no longer need. We will not promise more than that. No website is entirely secure. If your information is exposed, we will notify those affected, as the law requires.

11. Cookies and analytics

Wix sets a small number of cookies that allow the site to function and that count visits. There are no advertising cookies and no cross-site tracking, and nothing collected here is used for ad targeting.

You may block or clear cookies for this site at any time. The site will continue to function.

12. If this project ends or changes hands

If the Campaign winds down or the site moves to a different organization, we will not transfer your contact information to that organization without asking you first.

13. Changes to this policy

If we make a material change, we will update the date at the top of this page and post a notice on the home page for at least 30 days.
